Notice of Settlement in Patent Infringement Lawsuit Concerning “Teribone™ Injection”

Asahi Kasei Pharma Corporation (Head Office: Chiyoda-ku, Tokyo; President: Yoshikazu Aoki; hereinafter “Asahi Kasei Pharma”) hereby announces that a settlement was reached on October 20, 2025, with Sawai Pharmaceutical Co., Ltd. (hereinafter “Sawai”) in the patent infringement lawsuit (hereinafter “the Lawsuit”) filed by Asahi Kasei Pharma against Sawai before the Intellectual Property High Court.
Under the terms of the settlement, Sawai has agreed not to manufacture and sell “Teriparatide for Subcutaneous Injection 56.5 μg [SAWAI]” (a generic of “Teribone™ Injection” for osteoporosis; hereinafter “Sawai Product”) as long as the relevant patent remains valid.
This settlement significantly contributes to the maximization of the value of Teribone™ Injection based on Asahi Kasei Pharma’s intellectual property strategy.
Asahi Kasei Pharma regards intellectual property rights as important management resources, and will continue to protect its intellectual property through resolute action against any infringement.

Summary: Based on the process patent (Patent No. 6025881) concerning Teribone™ Injection, for which Asahi Kasei Pharma has obtained marketing approval, Asahi Kasei Pharma sought an injunction against the manufacture and sale of Sawai Product, a generic version of Teribone™ Injection, as well as compensation for damages.
In the first instance judgment, the Court ordered Sawai not to manufacture, sell, or offer for sale Sawai Product using the patented process, and to pay approximately JPY 3 billion as compensation for damages.
Prior to the judgment, on September 4, 2023, the Osaka District Court issued a provisional injunction ordering Sawai to cease the manufacture, sale, and offer for sale of the Sawai Product. Since then, the manufacture and sale of Sawai Product has been suspended.
